1. Acceptance of Terms

By downloading, installing, or using Golf Lab AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Golf Lab AI is a mobile application that provides AI-powered golf swing analysis. Users can record or upload videos of their golf swings, review them position by position, receive automated feedback and drill recommendations, draw on video frames, track their progress and scores over time, and share swings with others for feedback.

3. User Accounts

  • You may use the App as a guest or create an account using Apple Sign-In or Google Sign-In.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information when creating an account.
  • You must be at least 13 years old to use this App.

4. User Content

"User Content" refers to videos, notes, annotations, and other content you create or upload through the App.

  • You retain ownership of your User Content.
  • You grant us a limited license to process, store, and transmit your User Content solely to provide the App's services.
  • You are responsible for ensuring you have the right to upload any content, including videos of other individuals.
  • If you share a swing via a link, anyone with the link can view the video and its analysis and post comments or drawings on it. You are responsible for who you share links with.
  • You agree not to upload or post content that is illegal, harmful, or violates others' rights, including comments and drawings on shared swings.

5. AI Analysis Disclaimer

The AI-powered swing analysis is provided for informational and educational purposes only. It is not a substitute for professional golf instruction. We do not guarantee the accuracy, completeness, or usefulness of any analysis. You should consult with a qualified golf professional for personalized instruction. We are not responsible for any injuries or damages resulting from following AI-generated suggestions.

6. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws.
  • Attempt to gain unauthorized access to the App or its systems.
  • Interfere with or disrupt the App's operation.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App to harass, abuse, or harm others.
  • Upload malicious code or content.
  • Resell, redistribute, or commercially exploit the App without permission.

7. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Golf Lab AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

8. Subscriptions & Payments

Golf Lab AI offers a free tier with a limited number of AI analyses per month and an auto-renewing paid subscription ("Pro") that removes those limits and includes additional features. Subscriptions are billed through Apple's App Store and renew automatically unless cancelled at least 24 hours before the end of the current period. Subscription terms, pricing, free trial details, and renewal policies are displayed at the time of purchase. You can manage or cancel subscriptions through your Apple ID settings. Refunds are handled according to Apple's refund policies.

9. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLF LAB AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Golf Lab AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in the United States.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the App and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
